Chapter 1. General Provisions
Article 1. Purpose
These terms and conditions set forth the rights, obligations and other responsibilities that exist between “Asiana Airlines” and the users, in the use of the Internet-related services provided by Asiana Airlines, Inc. (hereinafter referred to as “Asiana Airlines) through its website (hereinafter referred to as “flyasiana.com”).
Article 2. Definitions of terms
① "flyasiana.com" means the virtual business site that Asiana Airlines has established to enable users to transact goods or services through the use of information communication facilities such as computers, etc.
② "User” means the member or non-member who accesses flyasiana.com and uses services provided by Asiana Airlines according to these terms and conditions.
③ “Member” means the person who has submitted personal information and subscribed to "flyasiana.com", and continuously uses the information and services provided by Asiana Airlines through "flyasiana.com".
④ “Non-member” means the person who uses information and services provided by Asiana Airlines without subscribing as a member.
⑤ “Asiana Club” means the group of members who have consented to the terms and conditions of Asiana Club, and earn bonus mileage for using Asiana Airlines and/or its affiliated businesses, and use the earned mileage.
⑥ “Internet Member” means the Asiana Club member who has registered his or her ID and password to use “flyasiana.com”.
⑦ “Partner” means the partners of Asiana Airlines selling goods and services at flyasiana.com or the partners operating linked websites.
⑧ “Asiana-Linked Website” means the website linked with “flyasiana.com” through a hyperlink, or through another means (including text, image, and moving image)
⑨ “Personal Information” means the information through which one can identify a specific individual, and includes his/her name, e-mail, or other items included in the relevant information. It also includes any information that is non-identifying when used alone, but identifying when used in connection with other information.
Article 3. Disclosure and Revision of the Terms and Conditions
① Asiana Airlines shall post the contents of these terms and conditions, business name, contact information, business address, etc. on the initial service page so that users can be aware of them. Notwithstanding the foregoing, the contents of the terms and conditions may be provided to users through a separately linked screen.
② From time to time, Asiana Airlines may revise these terms and conditions. Such revisions shall not violate the relevant laws, including the ‘Act on consumer protection in electronic commerce transactions, etc.’ ‘Act on the regulation of standardized contracts,’ ‘Framework act on electronic commerce,’ ‘Digital signature act,’ ‘Act on the promotion of information and communications network utilization and information protection, etc.’ ‘Act on Door-to-Door sales, etc.’ ‘Framework act on consumers,’ and others of Republic of Korea.
③ In the event that a revision is made to any provisions in these terms and conditions, Asiana Airlines shall provide a notice of the details and the reasons for such revision as well as the date of their application, along with the current provisions, on the initial page for a period from seven (7) days prior to the date of their application to the day before their application.
④ Revised provisions shall be applicable to users registered as members before the relevant revision upon a notice to the extent that such revised provisions do not violate the relevant laws. However, in the event that any member expresses his or her explicit refusal of such revised provisions no later than the date of their application, the provisions in force before the revision shall be applied to such member.
Article 4. Rules Other than Terms and Conditions
Any matters that are not provided in these terms and conditions or their interpretation shall be governed by the ‘Act on the regulation of standardized contracts,’ the ‘Act on consumer protection in electronic commerce transactions, etc.’ the ‘Framework act on consumers’ of Republic of Korea and general trade practices in Republic of Korea.
Chapter 2. Use of Services
Article 5. Provision of Services
① Asiana Airlines will offer the following services through “flyasiana.com”.
1. Provision of information related to airline ticketing and purchase
2. Provision of information related to Asiana Club
3. Provision of information related to travel and tour products, etc.
4. Introduction of various services provided by Asiana Airlines
5. Other services, as designated by Asiana Airlines
② Asiana Airlines, at its sole discretion, may supplement, adjust, or modify the contents of the services provided in the preceding provision, if necessary.
Article 6. Use and Limitation of Services
① In principle, the services will be available 365 days a year, 24 hours a day.
② Asiana Airlines may cease the provision of services temporarily when required for maintenance/repair, or due to breakdown of information communication equipment such as computers, breakdown of the system, interruption of communications, etc.
③ Asiana Airlines shall not indemnify any user or a third party, nor compensate for any damages caused by the interruption of service provision due to the reason specified in the preceding provision 2, unless such damages have been caused by either an intentional act or the gross negligence of Asiana Airlines.
④ Some of the Internet services provided by Asiana Airlines may be available only to members of “flyasiana.com.”
⑤ In the event that a user commits any of the following acts, Asiana Airlines may block or interrupt the use of the services, without being required to give prior notice to the user:
1. Any behavior violating public order or public morals
2. Any behavior presumed to be related to a crime
3. Any use of the service for the purpose of obstruction of the public interest, or the planning of the same
4. Any behavior that appropriates another user’s ID or password
5. Any act of defamation or insult of others, or other harmful act
6. Any act of double registration (registration of more than one ID by a user)
7. Any behavior that prevents the sound use of the services, such as the interruption of service provision
8. Other behaviors violating applicable laws or the terms and conditions of Asiana Airlines
⑥ Asiana Airlines shall not indemnify any user nor compensate for any damages caused by the interruption of service provision due to the reason provided in the preceding provision 5.
Article 7. Subscription of Members
① A user will be registered as a member by expressing his or her consent to the terms and conditions after providing member information, pursuant to the registration form provided by Asiana Airlines.
② By clicking the “I agree” button on the screen, the User shall be deemed to have given legal consent to the terms and conditions. A person under the age of 14 can apply for registration by consenting to these terms and conditions through the consent of his/her legal representative. (This clause is only applicable to persons of Korean nationality).
③ A user who wishes to become a member shall register for membership under his or her real name, and provide the personal information requested by Asiana Airlines.
④ In any of the following cases, a user shall be prevented from registering as a member:
1. The user applies for registration under the name of another person, or a fictitious name
2. The user makes a misrepresentation in the application form, in part or in whole
3. In the event that 3 years have not elapsed since an applicant lost the qualification for membership in accordance with Article 8, subsection 2 of these terms and conditions
⑤ A member shall maintain up-to-date information by personally modifying and registering any changes in "Member Information".
⑥ Any information included in the application is deemed to be true. The member shall be responsible for any inconvenience that results from his or her failure to keep the membership information up to date.
Article 8. ID and Password of Member
① A member who intends to use the services of the website shall register his or her ID and password on the Asiana Airlines website in accordance with instructions of Asiana Airlines.
② A member is responsible for the management of his or her ID and password. A member shall not disclose his or her ID and password to a third party, or allow a third party to use his or her ID and password.
③ If a member realizes that his or her ID and password have been used by a third party, the member shall immediately report the fact to Asiana Airlines, and follow the instructions of Asiana Airlines if applicable.
Article 9. Withdrawal and Termination of Membership
① A member who wishes to withdraw from membership may do so at any time by selecting ‘Withdraw Membership’ from the menu in the MY ASIANA section of flyasiana.com.
② In any of the following circumstances, Asiana Airlines may restrict the use of the services by the member, or disqualify the member:
1. Death of the member
2. Misrepresentation, or double registration (registration under more than one ID)
3. The member interferes with another’s use of the service, or commits an unethical act, such as the illegal use of another’s information
4. The member refuses to pay for an airline ticket purchased through “flyasiana.com”, or fails to perform his or her obligation for the use of service provided by Asiana Airlines
5. The member commits an act that is prohibited under these terms and conditions, or commits any violation of the laws or other public orders or customs in the use of “flyasiana.com"
6. The Asiana Club member who has registered his or her ID at the website has not logged into the website, the mobile app or the mobile web of Asiana Airlines for a period of three years
③ In the event that a member loses his or her membership status for one of the reasons specified in the above provision and his or her membership registration needs to be terminated, Asiana Airlines may give a prior notice to the member and hear from the member, except for the case specified in Clause 2 and 1.
④ In the event that a member loses his or her membership status for one of the reasons specified in Clause ②, Asiana Airlines shall not be responsible for any related damages to the member.
Article 10. Notification
① When Asiana Airlines gives a notification to a specific member, it may provide such notification to the member via the e-mail address submitted by the member, or communicate with the member by mail, telephone, or other methods.
② When Asiana Airlines gives a general notification to all members, it may notify them by publicly posting such notification on "flyasiana.com" for more than seven (7) days, rather than through individual contact.
Article 11. Distribution of Information
Asiana Airlines may provide members with diverse service information, such as information on the use of the service and various promotional events (commercial advertisements), travel information, etc. through e-mail, mail, SMS (short message service), or other methods. However, any member who does not want such information may refuse to receive the information provided by Asiana Airlines.
Article 12. Purchase of Tickets
① User may apply to purchase an airline ticket or other good/service in accordance with the process provided on “flyasiana.com.”
② At its sole discretion, Asiana Airlines may not approve the application for purchase made under the preceding provision in any of the following circumstances:
1. If there is any misrepresentation, omission, or error in the application
2. If approval of such application for purchase is prohibited under existing laws/regulations or the regulations of Asiana Airlines
3. If it is deemed that the approval of such application for purchase may cause a significant difficulty under the technology of "flyasiana.com"
③ Asiana Airlines’ approval of the user’s application for purchase shall be deemed to have been granted when the user receives a confirmation notice of receipt.
④ The user who receives the aforementioned confirmation notice of receipt may cancel the application for purchase or make a request for a change, and Asiana Airlines will manage it accordingly.
Article 13. Methods of Payment
The user who purchases an airline ticket or other good/service through “flyasiana.com” may make payment using one of the following methods specified by Asiana Airlines:
1. Credit card payment
2. Real-time account transfer
3. Payment with Asiana Club miles
4. Other methods of payment defined by Asiana Airlines
Chapter 3. Protection of Information
Article 14. Protection of Personal Information
① When collecting information from the user, Asiana Airlines will collect the minimum information necessary to provide the service and fulfill the contract.
② Details regarding the protection of personal information shall be governed by the privacy policy of Asiana Club and the privacy policy of the website.
Chapter 4. Responsibilities and Obligations
Article 15. Obligations of Asiana Airlines
① Asiana Airlines shall not commit any activity that is prohibited under the laws/regulations and these terms and conditions, and shall strive to provide continuous and stable services in accordance with these terms and conditions.
② Asiana Airlines shall maintain the security of personal information or other information so that users can use the services safety, and shall take all technical measures to make assurance of this.
③ Asiana Airlines shall maintain reliable E-commerce through the fair and sound operation of flyasiana.com, and will strive to provide high-quality service through constant research and development.
④ Asiana Airlines shall post no misleading or unfair indication or advertisement, as defined in Article 3 of the [Fair Indication/Advertisement Act], for the goods or services provided through “flyasiana.com.”
⑤ Partners shall be responsible for sales of goods or services of partners registered at flyasiana.com, and Asiana Airlines shall serve as a broker through flyasiana.com.
Article 16. Obligations of Users
① The user shall comply with the relevant laws, the provisions of these terms and conditions, and other instructions and directions provided and given by Asiana Airlines, and shall not interfere with the normal operations of Asiana Airlines.
② The user shall fill out the application honestly and sincerely based on the facts. Should a change in the circumstances of the user result in changes to the information provided, the user shall amend it accordingly. If user fails to amend the information provided, he or she shall be liable for all resulting damages.
③ The user shall neither copy, reproduce nor modify the information obtained in the course of using the services without the prior consent of Asiana Airlines, and is prohibited from using such information for commercial purposes.
④ The user shall not be allowed to do any of the following, except when provided for in the preceding provision.
1. Change the information posted on “flyasiana.com” by Asiana Airlines
2. Transmit or post information (such as computer programs, etc.) other than the information specified by Asiana Airlines
3. Infringe the intellectual property right of Asiana Airlines or a third party
4. Commit any act that causes damage to the reputation or image of Asiana Airlines or other third parties, or interrupts their normal operations
5. Commit any act of disclosing or displaying information that contains obscene or violent message/image/voice, or is against good public order, on “flyasiana.com”
6. Commit any act of selling goods or soliciting custom using the bulletin board of flyasiana.com
7. Commit any other act that Asiana Airlines deems inappropriate
⑤ In the event that any information which Asiana Airlines deems inappropriate for the operation of “flyasiana.com”, including information specified in the preceding provision, is posted on or linked to flyasiana.com, Asiana Airlines, at its sole discretion, may delete the relevant information or block the link without the consent of the user or other subscribers.
Article 17. Relations of “flyasiana.com” and Other Websites
① In the event that “flyasiana.com” and a second website are connected through a hyperlink (including text, image, and moving image), Asiana Airlines shall not be liable for the goods or services independently provided by such linked website.
② Asiana Airlines shall not warrant the credibility of information or data posted on the bulletin board of flyasiana.com by the user, and shall not be liable for any damage caused by such information or data.
Chapter 5. Miscellaneous
Article 18. Ownership of Copyrights
① Copyrights or other intellectual property rights to works made by Asiana Airlines shall be owned by Asiana Airlines.
② With regard to the information obtained in the use of “flyasiana.com”, the user shall not use information for which Asiana Airlines owns the intellectual property right for commercial purposes by copying, transmitting, publishing, distributing, broadcasting, or other methods, nor shall the user provide such information to a third party without the prior consent of Asiana Airlines.
Article 19. Disputes
① Asiana Airlines will manage a Customer Satisfaction Team, which takes full responsibility for reflecting reasonable opinions or claims raised by users and compensating for related damage.
② If a user has any complaint about the use of flyasiana.com operated by Asiana Airlines, or wishes to express his or her opinion, the user can present such opinion to the Customer Center on the website, or to the Call Center.
Article 20. Jurisdiction and Governing Laws
① Asiana Airlines and the user shall make every effort to mutually and amicably resolve any disputes or claims that occur in relation to the terms and conditions.
② In the event such efforts do not bear fruit, and a lawsuit or legal proceeding is submitted, the Seoul Central District Court shall have exclusive jurisdiction over such lawsuit or legal proceeding, and the law of the Republic of Korea shall be the governing law.
Article 20. Effectiveness of Terms and Conditions
These terms and conditions shall be effective as of June 1, 2000, and shall be applied retroactively to all users who became members before the enactment and enforcement of these terms and conditions. In addition, any revised terms and conditions shall in principle be applied to contracts entered into before the date of application.
The Terms and Conditions listed on this site are based on that of the official Korean interpretation, and in the case of any discrepancy, the Korean interpretation will take precedence.
