Baggage Compensation Liability
Asiana Airlines compensates passengers if their baggage is damaged as a result of the company's negligence or fault during the process of transporting, storing, and managing baggage.
Liabilities
- The limits of Asiana Airlines' liability for checked baggage is 250 Gold Francs or an equivalent amount (about USD 20.00) per kilogram if the transport is subject to the Warsaw Convention, and up to 1,288 SDRs (Special Drawing Rights) per person if the transport is subject to the Montreal Convention.
- As an exception, if a higher price was reported and closing prices were paid in advance, the limits of Asiana Airlines' liability will be based on the reported price.
- If there is damage to the baggage or if its contents are lost, you must report the facts in writing to the airline within 7 days from when the baggage was claimed. If baggage is delayed or lost, you must report the facts in writing to the airline within 21 days from when you checked the baggage to the airline.
Exemptions and Limitations
In the following cases, compensation is exempt or limited compensation will be provided in accordance with transportation laws or the Montreal Convention.
- If it can be proven that the company took the necessary measures to prevent damage or that the company was unable to take the required measures due to reasons attributable to force majeure;
- If damage occurred due to the passenger's intention or fault;
- If baggage was damaged because it was too heavy or too many items were packed considering the bag's capacity (including content damage or loss in addition to baggage damage);
- If the lock breaks during the security checkpoint process or films become damaged by passing through the x-ray;
- Minor scratches, abrasions, dents, chips, stains, etc. that occurred during the normal process of handling baggage;
- The following are items that are prohibited for transport as checked baggage, and must be taken as carry-on baggage.
- Items that are easily damaged, items that are prone to decomposition, instruments, etc.
- Health related medicine
- Laptop computers, mobile phones, cameras, camcorders, MP3 players, and other costly personal electronics or data
- Cash, gems or jewelry, marketable securities, documents such as contracts and dissertations, passport, identification cards, keys, samples, antiques, and other items that are difficult to appraise
